Divorce is a stressful time for everyone involved. Even when a couple decides they would be better off living separately, there are difficult issues to deal with during divorce. When couples cannot agree about property division, the courts will use what is known as equitable division. This does not mean equal, it merely means fair to both parties. The family home, retirement accounts, bank accounts, and other assets will be viewed in their entirety. Additionally, the court will also take into consideration the amount of debt owed by the couple and each person’s ability to support themselves financially after divorce.


Another common area of disagreement is child custody. While both parents may feel they are addressing the best interests of their children, they may have different ideas about what is best. Courts will take into consideration what is best for the child and in some cases, the children’s wishes may be a factor. Reaching an agreement without going to court can be less harmful but when necessary, we will work hard to advocate your position.
